Terms of Service

These Terms of Service ("Terms") are an agreement between you and Momentality LLC ("Momentality," "we," "us"). They cover your use of the Momentality app, website, and related services (the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms.

Who we are

Momentality LLC makes Momentality, an app that helps families manage calendars, schedules, and the details of family life, with help from Elle, our AI assistant. You can reach us at hello@momentality.app.

Eligibility

You must be at least 18 years old to create an account or subscribe. Momentality is designed for households, and adults may add information about their children and others in their household. You're responsible for having the right to share any information you add about other people.

The Service and Elle

Momentality connects to the calendars and accounts you choose and helps you keep track of events, tasks, and schedules. Elle is powered by AI models from Anthropic and xAI. AI can make mistakes: Elle's suggestions, summaries, and reminders may be incomplete or inaccurate, so please double-check anything important. Elle and the Service do not provide medical, legal, financial, or other professional advice. We may change, add, or remove features over time.

Your account and security

Keep your sign-in details secure and tell us at hello@momentality.app if you think someone has accessed your account without permission. You're responsible for activity on your account. Please give us accurate information and keep it up to date.

Subscriptions and billing

Founding members (pre-launch)

If you become a founding member before launch, you pay a one-time $29.99 pre-launch payment (plus any applicable tax) at signup, through our payment processor, Stripe. Your subscription then renews automatically at $29.99 per month, starting about 30 days after launch, and you'll be charged each month until you cancel.

Founding price lock

Your $29.99/month founding rate stays locked for as long as your subscription stays active and continuous. If you cancel or your subscription lapses, the founding rate ends, and rejoining later may be at the then-current price. Pricing for new customers may be different.

Cancelling

You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then. To cancel, email hello@momentality.app.

Refunds

Refunds are handled as required by applicable law and, for purchases made through an app store, according to that app store's policies.

App store purchases

If you subscribe through the Apple App Store or Google Play, your purchase is also governed by Apple's or Google's terms, and billing, renewals, cancellations, and refunds are managed through your app store account.

Acceptable use

Please don't misuse the Service. For example, don't:

• break the law or violate anyone else's rights, including their privacy;
• upload content that is harmful, abusive, or that you don't have the right to share;
• try to access accounts or data that aren't yours, or interfere with or disrupt the Service;
• reverse engineer, copy, or resell the Service, or use it to build a competing product;
• use Elle to create harmful, deceptive, or illegal content.

Your content

You own the information and content you add to Momentality. You give us permission to host, store, process, and display it only as needed to provide, maintain, and improve the Service for you, including sharing it with the service providers described in our Privacy Policy, such as the AI providers that power Elle.

Third-party services

The Service works with third-party services, such as the calendar and email accounts you connect, Google, and Stripe for payments. Your use of those services is governed by their own terms and policies, and we aren't responsible for them. You can disconnect connected accounts at any time.

Privacy and account deletion

Our Privacy Policy explains how we collect and use information. You can delete your account at any time; see Delete your Momentality account.

Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, error-free, or that it will catch every event, conflict, or reminder.

Limitation of liability

To the fullest extent permitted by law, Momentality LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or missed events, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.

Termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms or if we need to in order to protect the Service, other users, or comply with the law. If we discontinue the Service, we'll give reasonable notice where we can.

Changes to these Terms

We may update these Terms from time to time. If we make meaningful changes, we'll update the effective date above and let you know, for example by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules, except where the law where you live requires otherwise.
